Many people think that once a case is filed in court, there is no turning back. This is not true. In Malaysia, settlement is possible at almost any stage of a lawsuit, even after court papers have been filed and hearings have begun.

 

In fact, majority of civil cases end through settlement rather than a full trial.

 

1. Filing in court does not lock you into a dispute

 

Starting a lawsuit does not mean you must continue fighting until the judge decides everything. Filing in court simply means you have formally brought the dispute before the court. After that, parties are still free to: 


  • Discuss the matter 

  • Negotiate terms 

  • Compromise on certain issues 

 

The court process does not stop parties from reaching their own agreement.

 

2. Settlement can happen at different stages

 

A dispute can be settled: 


  • Shortly after the lawsuit is filed 

  • During case management (court sessions to manage timelines) 

  • Midway through the trial 

  • Even after the trial has ended but before judgment is delivered 

 

Sometimes, parties only become more realistic about settlement after seeing the strength or weakness of the other side’s case.

 

3. Courts encourage settlement

 

Malaysian courts generally encourage parties to settle where possible. Judges often ask whether parties have explored settlement or mediation. Settlement helps save time, cost, and judicial resources, and parties should not be discouraged from resolving disputes amicably even after litigation has started.

 

4. How settlement is usually recorded

 

When parties settle a case, the agreement is usually recorded in one of these ways: 


  • A Consent Judgment (a court order agreed to by both parties) 

  • A withdrawal of the case with agreed terms 

  • A written settlement agreement followed by closing the court file 

 

Once properly recorded, the settlement has legal effect and can be enforced if breached.

 

5. Why people still choose to settle late

 

People often settle after filing because: 


  • Legal costs are increasing 

  • Litigation stress becomes overwhelming 

  • Business or personal relationships need to be preserved 

  • The risks of losing become clearer 

 

Settlement allows parties to control the outcome instead of leaving everything to the court.

 

6. Things to be careful about

 

Not all settlements are equal. Poorly drafted settlement terms can lead to: 


  • New disputes 

  • Enforcement problems 

  • Claims that the settlement was unclear or incomplete 

 

This is why settlements should be documented carefully, even if both sides feel cooperative at the time.

 

Final thoughts

 

Filing a lawsuit does not close the door to settlement. In many cases, it opens the door to more serious discussions. Resolving a dispute early or even late can save time, money, and emotional strain, as long as the settlement is properly recorded.
